Welcome to Fundex Inc. ("Fundex", "we", "us", or "our"). These Terms and Conditions govern your access to and use of our website, services, and trading evaluation platforms.

1. Acceptance of Terms

By accessing our website and participating in our evaluation process, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using our services.

2. Description of Service

Fundex provides a simulated proprietary trading evaluation program. Upon successful completion of our evaluation phase(s) in accordance with our specific trading rules, traders may be granted access to a funded account where they can trade live capital on behalf of the company and share in the profits generated.

3. Eligibility

You must be at least 18 years of age to use our services. Our services are not available to residents in jurisdictions where participation in proprietary trading programs or CFD trading is restricted or prohibited by local laws.

4. The Evaluation Process

Traders must adhere to all stated rules during the evaluation period, including Max Daily Loss and Max Overall Drawdown limits. Failing to abide by the rules will result in immediate termination of the evaluation account without a refund.

5. Payouts and Compensation

Funded traders act as independent contractors. Payouts are provided as a percentage of the net profits generated on the assigned funded account. Fundex assumes all trading losses resulting from normal trading activity; however traders are solely responsible for all taxes related to their independent contractor earnings.

7. Amendments

We reserve the right to modify these Terms at any time. Any changes will be updated on this page. Your continued use of the services after such changes constitutes your acceptance of the updated terms.

These terms are governed by the laws of the jurisdiction where Fundex Inc. is legally incorporated, without regard to its conflict of law principles.
